    thanks davet. it's a week tomorrow that my court case starts, i'm feeling quite calm at the moment in the knowledge that soon it will all be over one way or another.

          In my case the girl also claimed to be so drunk that she was unconscious, however because she had reported the "rape" quickly (within hours of the alleged offence (and within minuets of arriving home to her partner at 6am with no good excuses of where she'd been all night!)) a urine sample was taken. This turned out to be great news for me as it showed only a very small amount of alcohol in her system, about 3 small glasses of wine, which is obviously not enough to lose consciousness.
          Are you aware if your accuser was tested for alcohol levels? And did she report ver soon after the alleged offence? Just though it may be of use. Good luck anyway, hope it goes well for you.

            Hi Raptorace,

            The girl in my case claims that she was unconscious and woke to me penetrating her, she reported the alledged rape within minutes! Managed to coherantly text all and sundry, get dressed unlock the front door and meet her ex lover down the road (and then rang the police) - which is quite a feat considering she was "unconscious" to fully conscious, coherant within minutes. She has a urine sample taken which showed there was a fair amount of alcohol in her system however no where near the "unconscious" stage.

            My accusers story doesnt make sense to me - she was texting for help from her ex lover when her friend was in the next room (which she would have had to walk past to leave), who she could have been with within seconds. Not only that but my accuser didnt even go in and warn her friend of a so called "potential" rapist.

            I just can't work out why this has happened or how it has got this far! But it has so I just have to play the card that I have been dealt.

              good morning, do you mind me asking how long this has been going on from start to finish, i am interested to see how long different people are having to wait for cases to come to court, by the time my son gets to court it will have been 18 months since the alleged incident happened .

                My sol who deals alot with rape told me one of the main reasons for a false allegation is to hide the truth about a alcohol feuled regretted sexual encounter from a partner. A very angry partner turns immediately into a supportive sympathetic puppy dog at the mention of " I didn't want to have sex with him, I was drunk And came to around with him having sex with me" partner laps up the BS because they don't wNt to believe their girl has actually cheater on them and calls the police, my girlfriend has been raped! It's easy to see how it happens I think. And once the card is played, how can she go back!
                There's a good video on y@@tube about a girl who admits this is what she did. She ends up doing two years herself, but the guy she accused had already done 2 years by the time she admitted it!

                  Hi Raptorace,

                  It does sound feasable and that is what I originally thought, however I don't know whether a jury would believe that a female has reported a one night stand as rape to get attention from her ex lover. This is however the tactic that I think will be played as there is no other logical reason or reason for her contacting an ex lover before the police or even parents (who were contacted almost an hour after she had contacted her ex lover!)

                  My accuser is known as being an attention seeker and to have mood swings and stuff (she actually admitted to having mood swings in her statement). However whether her being an attention seeker will be allowed to be said by witnesses in court is another matter as I suppose it will be "hearsay"

                  I just can't see how my accuser can be conscious and coherant getting home (15 min taxi ride at least since her last drink) to being unconscious in her words during the sexual intercourse (an hour and half after getting home) to being fully conscious and coherant a couple of minutes later when texting everyone and leaving the house! I just dont see how she can get away with saying that and be believed.

                  There are just so many things running through my head at the moment.

                  And kazzarat; from start to finish this has taken 10 months; 10 worrying, anxious months that I hope will never be repeated.

                    We know how you feel

                    Hey you have to keep strong and im sure its natural for all these thoughts to keep running around your head, i know i have them every night, we have been going through this now since july 2010 and it has been the worst time of our lives and the same as you we wonder how it has been allowed to get this far. We are waiting for the soliciter to send the statements to us as they have all but a few been received, i have breifly seen the accusers and it is absolutely rubbish and full of lies (thats only the bit that i have read whilst in the soliciters office with my son)
                    You will soon be able to get on with your life.
                    When this is all over for us i am going to dedicate my spare time to campaigning about false accusers and how nothing is done to them in the majority of cases. I am sure i will have a lot of support.

                      First person she goes to is ex lover!! Strange isn't it? Could she want him back, and want him feeling sorry for her and taking the supportive role.
                      I truly hate women like this who have no care for the world of pain they cause.

                        Did you not get an advanced disclosure with most statements in it? I got that at magistrates court from my solicitor. In my case there was no additional evidence when I got to see everything that the solicitor had to work with, other than the hand written statements were typed up.

                        I too will be putting some time to the side to support others that are going through what I am. (that is of course if justice is done and I am found not guilty!!)

                        It is indeed "strange" that she goes to her ex lover instead of her friend next door. Absolute attention seeking exercise in my opinion. It is also strange that forensic photography shows that she had an unused prenancy test kit in her room and a stash of condoms (of which i was not offered one of) - this can be both used in my favour and against I am sure!

                          Morning, no we didnt we havnt received any statements as yet, we are still waiting for the soliciter to send them, we have breifly seen her statement which like i said had lots of discrepencies in it, i am going to ring them today to see where they are, its all so confusing when you dont know whats happening isnt it ?

                            hi, i havent updated in a while so thought i would let you guys know where we are up to. Today will be the closing speeches so i will have my verdict today. tuesday was the prosecution case where the victim was very flaky and answered most questions with 'i cant remember, i have been blocking it out' then there star witness decided to pretty much change sides and so in turn when the prosecution barrister was asking her questions it was as if he was working for defence! yesterday was hard going, the jury was cleared out about 4 times as the prosecution barrister was getting his knickers in a twist. he then tried to get my defence witness dismissed but continued to questions him anyway. everyone went well and then it was my turn in the box. due to the length of my interview was agreed to use only the first msin description that i gave. the prosecution tried to use this against me by asking questions which had been in later parts of the interview. this was swiftly sorted out by the judge anr my barrister. the questions then led on to the "we sugget this" "you did this" questions, the type where they are trying to get you to confess and where the oly answer can be no. the prosecuion barrister threw his toys from his pram on numerous occasions and even suggested to the judge to step down from the case and be replaced. he seemed very rattled.
                            my barrister seems optimistic and sshe also asked the opinion of the person doing the tape recording for me, whos said he thinks the ccase is dead in the water and he would return a not guilty verdict if it was him.

                            so now my future is down to 12 people who will decide my fate! i will let you know if i am found not guilty!
