  • Would it be in the interest of a solicitor?

    Hello all,

I was just sat here thinking about the possibility of trial if I don't receive an NFA and this thought crossed my mind...

The duty solicitor I had, and who is dealing with my case, was talking about how much of a "good earner" a rape case is, could a solicitor stop short of trying to get the case thrown out at pre-trial stage so they can earn more money?
Is it really in the interest (at least financially) of a solicitor to try and stop a case going to court?

NO - absolutely not. What utter rot. Public funding is public funding and doesn't pay for a fat lot.

ouch, sorry RF, my mind runs away with me sometimes, I always end up looking too deeply into things.

I apologise if I have offended you.

No offence taken - just I am fed up with people believing that sols make lots of money on public funding (legal aid).

I know that some sols will take private funding and do not a lot, but public funding has been cut to the bone and every penny has to be accounted for.

          That's understandable.

I'm very naive to the legal process, solicitors, courts etc.
I wasn't having a go (i dont know enough to do so), just asking a genuine question.

I totally understand you jumping on this if people say things like that often.

Text doesn't have tone of voice sadly else you'd have known it was a genuine naive question lol.

There are some rogue sols AND barristers but then you get rogues in all walks of life; jobs; Government etc.

I work for a thoroughly decent sol and if the client is a privately paying client I've known them to be given change if they have overpaid or they get their money back if it's a not guilty or conviction quashed.

I lent a client some money to help pay for a barrister for appeal (as they were not eligible for funding) and when the appeal succeeded, although it took a few months for the money to come through (not the barrister's fault) we all got our money back - and my rail fares in and out of London for meetings with the barrister were all reimbursed as well - which I was not expecting.

The barrister paid me out of her own money saying that my assistance was "invaluable".

Not all legal bods are robdogs!
