    However, if I was in that situation and they pretended they had my dna and I knew I was innocent, there is no way on god's earth I would go guilty.

    I would stand my ground and take it to court and say okay, you say you've got my dna. Prove it. Let's have some experts look into it.

      I second that. I'm doing the same thing in my case, and I can guarantee if I mentioned it to the police they'd tell her and the posts would be magically gone.

        The solicitor was in the room with the my friend's brother when he was being interrorgated to plead guilty, could the poice still lie in front of the solicitor

          Of course they can. The solicitor doesn't know the truth any more than your brother's friend.

            Because the sample roughly matches (someone else in the family, so not completely wrong) they'll just claim later that they got it wrong.
            But they'll also say "it won't matter because he's gone guilty anyway."

              If my friend's younger brother is now scared because he admitted sleeping with this girl in November, can he be brought up for statutory rape she was 15 and he was 19

                They could well pursue that, esp if the main case falls apart. Sorry to bear bad news, but rather be honest than lie.
                Maybe just say nothing, and see what happens. U can drive yourself potty panicking about the what-ifs.

                  Can I just say the police lied to me. There seems to be no prohibition to PCs lying to obtain evidence. It seems pretty common practice. My solicitor tolo me to regard any policeman, custody officer, civilian working for the police, as my enemy even if they were really kind to me.

                      I'm helping somebody who is up for trial in November. The police officer blatantly lied to our man during his interview and also lied to the accuser with regard to what the suspect is supposed to have told them.

                      Most police officers will do the job properly but unfortunately you have to assume that the one you are dealing with is not. If you have not done what was alleged then this is your freedom at stake - some officers are more interested in getting the "detection" and ticking the quota boxes that getting to the truth.

                      The recent Lynette White case where officers manufactured evidence and scared people into not assisting the defence case proves that.

                          Mine field. Has he been accused of rape or statutory rape? The brother is guilty of statutory rape so saying its his dna will drop him in it. They can tell siblings apart but not identical twins.
                          If semen has been found on a 15 year olds knickers he's got quite a case to answer.
                          Laugh at your problems, everybody else does. The last thing I want to do is hurt you. But it's still on the list.

                            falsely accused

                            Hi, it has been a long time from i have been on here,
                            just a wee update to let you know what's going on.
                            My friend's family got the statements from the solicitor, everything the girl says on the statement is lies, she states that she never left my friend's bedroom until that night,(the night after she accused him) even though she went to her house that morning with my friend's cousin to get ready, she handed in the wrong pants, my friend knows this because she was running round the house on her bra and pants,

                            the dna that came back states that is below the borderline threshold, (what does this even mean)

                            What is baffling us and the solicitor is that there was dna on her pants, but there were no dna on her pjammas, sheets or his blanket. (surley they would get his dna of his sheets and blanket).

                            If this really happened, surely you would be to tramatized, The girl that is accusing my friend's brother came up to her house the next three days. I know if this happened to me, I would not go to the house where this guy was.

                            She has also accused a couple of people of this before, although she did not go to the police about it.

                            By the way she was seeing a mental health professional, well before my friend's brother was being accused. something is telling me she is mentally disturbed....

                              Unfortunately, if she is actually suffering from MH issues, this would make her more likely to be the victim of such an assault. However, it does also follow that many false accusers also have MH problems.
                              I can't answer the question about DNA because I simply don't know and I certainly don't want to give wrong info.
