Falsely accused
falsely accused of rape
My friend's brother is being falsely accused of rape. This girl in question has been going into my friends house for over a year now. All my friend's family get on with her, she seemed like a nice girl until saturday night,
My friend and the girl in question were out on the drink both (15yr old) The girl in question told my friend your brother tried to do something to me, there is no way this could have happened. It was suppose to happen in my friend's bed.
My friend's brother age 35 was suppose to come into the room and lie beside this girl in question, his sister was in the bed also. This is tearing my friends family to pieces. The police came and the forensic team came and took all the sheets away. The girl in question age 15 has always told lies, she even said she had a few miscarriages,
This is so unfair. My friend's brother is out on bail until the middle of April.
He can't eat, sleep, or even talk about it, he is devastated. This is destroying his life..

Hi Welcome to the site Sussie.
All I can say is that your friend's brother lying on the same bed as this person may well have DNA like hairs on it, but hairs don't get you a conviction for rape. If there was DNA which could only have arrived there from having intercourse, then that would be a different matter.
I'd be very surprised if he had anything substantial to worry about. Of course girls do make up false accusations, but with something so recent one would expect some physical proof. It's not as if it happened months ago and the sheets had been washed.
Bail until the end of April is not unusual, but I would say to expect about 9months+, as the police and CPS work reeeeaaally slowly, so expect a long wait and if the answer comes sooner then great.
Easier said than done, but best to try to get on with life in the meantime. Gather any evidence you can of this girl's lies, and keep it safe until you know what's happening with being charged or NFA'd (dropped).

Hi Sussie and welcome.
I know it sounds harsh but there is very little he can do until/if he is charged. On a practical note he should look for a specialist solicitor, one who is experienced in defending false allegations of sexual assault. The solicitor will not be able to do much until/if he is charged as no paperwork is released until then.
Your friend's brother should use this time on bail to write down everything he can remember about the evening in question. Even the tiniest detail could be significant. Keep an eye on her facebook status or any other social networking sites and take screenshots of anything that might be helpful.
If she is claiming that he raped her and sex, consensual or otherwise did not take place then I would say it is unlikely to proceed to charge. There will be no dna evidence inside her body. However some unscrupulous police could return to the "victim" and explain that there is no DNA. She could then change her mind and decide that he "attempted" to rape her.
If she is a known liar/attention seeker, talk to some of the people she has lied to and see if they would be willing to make statements.
Waiting is the hardest part. Chin up. We will do as much as we can to help.
