15 years ago my husband had sex with a girl at a party - they were teenagers at the time and it was a typical teenage party with lots of alcohol and noone really knowing what was going on. She was the ex-girlfriend of one of his friends (lets call him F). She started dating F again after the night and they dated for over a year. Throughout that time my husband & F remained friends. She didn't mention anything about the alleged rape.
Since then she has told a lot of people that they went to school with that he raped her, but has not made any accusation to the police.
She recently got in contact with his friend (F) to say that my husband raped her. She can't remember what happened exactly because she was very drunk. All she can remember is that she suddenly realised they were having sex and she didn't want to be there. Obviously Husband's recollection of the night is not perfect, but he can't remember her saying anything about not wanting to have sex. He did not get her drunk and did not push her into doing anything. He can remember things, like her taking her dress off, that suggests that she wanted to have sex.
My husband is now absolutely terrified of being arrested, even though he is certain that the sex was consentual. I would like to be able to reassure him that we aren't about to get a knock at the door, but I know nothing.
Has anyone had experience of a accusation so long after the event? If she did go to the police, what would happen next - would he be arrested immediately?
We are considering getting legal advice, but worry that this would look like an admission of guilt.
