  • Need your help. Been Falsely accused of rape.

    Hi,

    I am new on this forum but from reading some of Thread's it helped me a lot to understand my situation.

    Ok this is my story and would like some help please.
    I was Falsely accused of rape but don't know from who!
    The police called me on my mobile to go and see them but I never went
    After they went to my house to look for me but my house mates told them that I was on holiday they went to my work and asked for me there and my boss told them the same that I was on holiday.
    One month later I receive a letter from CID saying that they had received a complaint about me and that at that time they needed to arrest me for rape. But now on the letter they say that they no longer need to arrest me or speak to me as the accuser did not want to pursue further.

    I need your help to understand the meaning of all of this and what the police are going to do next as in the letter they say that the case is now filed

    dont panic. Take all letters you have recieved to a solicitor and your fears on the complaint being logged. They will sort it all out for you x

      this accusations happend 4 months a go and I only received one letter saying what I
      have posted above. what will be next if I don't see a solicitor now? and what do they mean the file is now filed?

        The case has been "filed" and not "No-Crimed" - which means they could resurrect this should further evidence come to light, either in the form of more "evidence" in the current (now dripped) case or should anybody make another separate allegation against you.


        You will probably have to pay for advice from a solicitor as to what the allegation is/was and who made it, as I doubt there will be public funding for these query. Some solicitors will give half an hour or an hour free.

          hi my partner also had a previous so called filed complaint.They did not take it further as the girl did not sign a statement. The police have the right to continue if it was signed,even if she didnt want to. I think its prob the same in your case. The good news is it wil never be allowed to be used as we have found out if it has not been signed.this said if another allegation is made by someone else in the future,the police will contact the first girl to persuade her to come forward. Just be really careful in future,you never really do know anyone. x

            We do not know the reason why the OP's case has been put to one side. It might well be that the complainant did not sign her statement, but then it might not be.

            Even if the statement is not signed, it will still be "filed" and it can be resurrected should any new evidence come to light or another allegations is made. Should that happen, the police would approach accuser number one and invite her to make a new statement.

              Sorry i thought thats what i said. pretty much. I didnt pretend to know. I just said its prob the same in this case.My reply was out of concern and not one that stated facts,other than it would be bought up if another allegation was made,just as you had said.I assume your reply was meant i was telling un truths.I speak from the experience ive had.I thought that was what this site was about.If everyone knew exactly why these things happen,this site would be of no use. I dont reply to cause an argument,or to pretend i knowbetter than anyone else.Nor do i critisise other peoples responses.

                Hi Keri, please don't be offended by anything. RF is simply making things clear because things sometimes need to be very exact as the law is such a twisty turny thing and that's what she does for a living.

                          hi thankyou for responding. I know how twisted the law is,and things can be taken out of context. Im studying the Archbold book, and crazy to say the least. Though not sure what i said,that was diff to the senior member. Actually maybe i do. It must of been because i said "so called filed complaint" Though to be fair that was about our experience, And "so called" i meant that we did not know of it previously.
