    Tango, so sorry to hear that things are getting on top of you. If you are feeling suicidal because of these lies, perhaps you should go to your GP to get something to help get you through in one piece. I felt like you at some points and found talking to the Samaritans really useful. I had never contacted them before and waited until I was so low, but after I had spoken to them I was so glad that I had. It helped me put things on perspective and gave me the strength to carry on.

    I truly hope that this nightmare is over for you soon.

      hi all the police have finally started to take my witness statements 6 months after the alleged inncident. because of there delay vital cctv evidence has been over written asm it only store for 28days, the cctv would show the girl coming back to the club 2 months later to party.(if you were raped would you return to the same club on a night out). also one of my witnesses heard the female say she would do anything for the passport back and beg me. is there a route i could take to complain about the lack of professinalism the police have shown which has let 3 cctv sets delete its self as they have not been bothered to collect it?

        this may be of some help re CCTV - it is possible under this code that solictors could request CCTV images before the police, if the police are being slow off the mark?

        I know when we had a problem with a local jeweller offering body piercings to underage children (our son had his ears pierced at 12!) we were able to request, and get, the CCTV footage of him entering the jewellers and getting his ears pierced even though he was obviously under 18. (he lost his licence)

        Unfortunately, when our son was accused, there was no relevant CCTV

          Hi thanks for your reply, its 2 late for the cctv the cctv was requested in december and only last 28days so its long gone. I am so gutted about this as it would be key and vital evidence

            Hi Tango,

            The only comfort you can take from this is that if the police had taken the girl's accusation seriously they would have been round to the club the very next day for the tapes!

            As is frequently mentioned on the forum, the police are not really interested in collecting evidence to prove the accused's innocence, but they wouldn't overlook anything that might prove their guilt.

            As long as you have an independent witness (i.e. someone who isn't related to you or a personal friend) who will be prepared testify in court that the girl said she was going to set you up for throwing her out, you needn't worry too much, I agree this doesn't help with the waiting and waiting and being suspended from your job; unfortunately in these cases the cards are stacked in favour of the accuser.

              Some would yes as it would be considered to be "getting back on the horse" - if you follow my drift.

              If the CCTV tapes could have shown something OTHER than the girl returning to the club for a night out (and it is pivotal to the case) then there may be an argument for an abuse of process which could stop the trial dead. If the judge does not accept that then there could be a ground for appeal.

              It really depends on the circumstances.

                The cctv. Would show 1 her going to the club next door to get in 5 mins after the alledged rape and 2 her friend coming back and say to my manager that he heard her say to her friends that she was setting me up. Its all evidence that a jury should see and hear if it ever went that far

                  1: Going to the club next door does not prove she was not raped. Crown could say she went in there to escape from you / get help / friends were there........

                  2: Not all CCTV has sound. What her friend might have said to the manager (that would have to be corroborated by said manager) would be classed as hearsay evidence. Although possibly admissible it doesn't go far enough to prove that the alleged rape did not occur.


                  You have to remember what the other side (Crown) would make of this to the jury. Get your sol to interview the friend.

                    I see where. Your coming from however when she went to the club next do she said to there door staff that I took her I'd and when refused entry she said she would do anything including sleep with the doorman for entry, I understand what your saying I'm just thinking of all avenues to explore

                      I am pleased you can see where I am coming from - some people see it as an interrogation or me being awkward however that is not the case. I've attended too many trials and reviewed too many appeals against conviction and know exactly how certain evidence can be twisted by the Crown.

                      Anybody facing trial should keep asking themselves "how would the Crown twist this part of my evidence or explain it away?" When you can answer that you then have to come back with an avenue that has nowhere for them to run to.

                        hi all just a update, i answered bail yesterday and they put to me a account they got of the girl 5 months ago (long gap i no). her account say that she came on to me as she wanted the id back but she felt scared because her mate would kick off due to the fact that her id got taken off of her. im now rebailed awaiting cps decision
