    Hi I'm new to the forum. I'm not a british citizen and i'm here in UK to study. I have a part time job as a healthcare staff. It was very traumatic for me as a foreigner in this country to suffer a great ordeal, i felt so very helpless. I was allegedly accused of doing sexual assault with one of our patient. Our ward has 4 bays, and male and female patient are separate. I was working that day in the male bays. This woman who apparently is confused accused me of sexual assault. I felt so bad because i dont know her at all bec im working at the other side of the bay, which is an all Male patient bay. The family reported it to the police, i did not heard any news after that. But After one month, i was called by an officer to have an interview to get my statements. I was so shocked when the officer told me that I'm arrested of sexual assault.. So i went to the process, mug shots, finger prints, DNA.. and was put into a cel while waiting for the duty officer. I was so humiliated. I'm really depressed right now I can't even have a nice sleep because of this incident. I was bailed out and have to go back on a specified date. I think the law here is very one sided, im not yet proven guilty,and i'm totally innocent. why do i have to go to the process which is very stressful, it seems that i'm already a criminal. I never tought it will happened to me. I'm a devoted christian and respect the elderly. It's one of our great tradition in my country. I'm really upset and depressed, i hope I can cope up with this. It's really unfair.. if after the investigation, they will tell me that im not guilty...it already ruined my life, my personality, my dignity as a person. And will happen to the lady who accused me..NOTHING!! she will just get away with her lies.
    It's really really unfair....... Can I accused the lady with moral defamation???? Please advise. but now, I wish i can go home now in my country and be with my family!!!

    As you rightly say 'justice' seems very one-sided in these cases, and an awful time of waiting for an outcome.

    If the woman is clinically confused (i.e. medically diagnosed with Alzheimers) then I can't see this going anywhere unless there are any other witnesses to support her allegations.

    If you weren't working in her part of the ward there will be none of your DNA on her bedclothes (even assuming these were taken for forensic examination)

    Again, as you say, it is neccesary for the person accused to prove their innocence and it may help you cope with the waiting to write down the sequence of events of that day: where you were working; what you were doing; who else was on duty; and so on.

    I may not be able to respond again for a few days, so try to keep positive thoughts in your head.

      one sided law

      Thank you! It was already one month since i was accused. But good thing I wrote all my activities that day.because it will be very hard for me to recall all the events that happened that day. I was already interviewed yesterday and made a written statement as per advice of the duty solicitor. I dont know the case of the lady if she has dementia or alziemers because i'm not on duty in the female bay that day, but according to the staff nurse she has uti that's why she's confused. I'm 101% sure that i'm innocent and even if i die today my conscience is clear. I hope this will end up soon because this is really affecting my life so much.!! Please pray for me! thank u!

        Sorry you find yourself in this situation.
        What is UTI?
        If you were not wokring in the accuser's bay that day are there any witnesses who can corroborate your whereabouts?
        I recommend that you look for a specialist solicitor, FASO may be able to help you. Try Googling "FASO" and their webpage wil come up.
        Others will probably be alon shortly, but in the meantime I will post this up as a new thread - more people will be able to see it that way.

          Saffron, UTI is an abbreviation for urinary tract infection.

          If the patient was confused it may be that she had delirium rath than dementia. If it was clearly documented about her confusion, i think it would be a difficult case to prove without some corroborating evidence like witnesses, DNA or other forensics.

          I am so sorry to hear how this has affected you. I hope that you get the chance to go home as everyone needs their loved ones at a time like this.

            Hi everyone thank u for all your support and advice. Shattered is right UTI is urinary tract infection, and if a patient has UTI she can suffer from confusion. It was noted in the notes that the patient is confused. They have no witnesses, and i think the police is just holding on the statement of the patient. I'll be back sometime in february to the police station and i think i will sit down on a magistrate court. but if they will decide that the case should be close before the date they gave me to report, then i dont have to go there. I just really wish this will end soon. My wife doesnt know about this bec, i dont want her to be stressed out, she's in our country taking care of our 2 daughters. This really makes my heart aches. I really don't know what to do. A friend suggested that i should build a case with my solicitor and gather evidences that would justify that i was not even working on the female bay. but i don't have money to pay a solicitor. im only depending on a duty solicitor. im unison member recently but i'm not sure if they can provide me a solicitor since i just joined the union. =( all i can do now is pray to God that this nightmare will end.

              Hi depressed sorry to hear your story!

              i think your doing the right thing by contacting your Union,

              i believe the police will just be following procedure as it is a serious allegation i cannot believe you have been arrested its truely disgusting the justice system.

              Hopefully you can rely on your faith and family to support you through this rollercoaster you will be on.

              I found myself turning a bit towards faith and having a few kind words from my local Priest really helped me, i msut admit i am not religious but i honestly cant believe the evilness in some people and i find myself questioning the morality of these women.

                Glad that you came to this site. You will get a lot of help and support. As dark times said, this is a serious allegation, so the police need to spend a good bit of time doing a full investigation. However given the situation you describe it seems likely that it will be difficult for the CPS to prosecute you with only the uncorroborated testimony of a lady who was documented in the medical records as confused.

                      Hi Depressed, sorry you are having a horrible time at the moment. Do ensure that you get closely involved with your union as soon as possible - when things like this occur on the job they will fund your legal support. I know my Union provided support to me for a different matter and I assume yours will also - is it Unison?

                        Thanks!yup UNISON is my Union, I'm coordinating with them right now. I just joined UNISON, after i had the complain, so technically they can provide me legal support on the 2nd week of february, but i hope they will help soon before that date.

                          hi! afterall those sleepless nights and stressfull days, today's the day that i felt so relieved. My case was already dropped.
