  • Was falsely accused, case almost over - What now?

    Back in March I was falsely accused of rape by someone I had thought of as a friend at the time. As she was in my circle of friends, I then lost a lot of people who were close to me as they were very quick to believe her.

    10 months on and the case is almost over - Both the investigating officer and one CPS lawyer want to throw it out, and all I'm waiting for is written confirmation from the second CPS guy. But what about action taken against her? Is it common for police to attempt to prosecute women over false rape claims? And if I take it to a civil court, how can I prove in the balance of probability that she knew the claim was false?

    It rarely comes to anything, the police aren't all that interested even if they know she did lie.

    It'll be a hard thing to do, but try to put it behind you and move on. You'll have bleak moments but you can conquer - whereas she'll remain the pathetic, lying trout that she's always been.

    And if the people went, then they are not worthy as being classed as friends - friends stick beside you through everything.
    And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..

      Taking out a civil action can cost thousands and you would probably lose. You would have to have evidence beyond ALL doubt (not reasonable doubt) that this was a malicious allegation.

      The Crown rarely prosecute liars and even then they will only do so if there is a real chance of conviction.

      RFLH is right - do try to move on otherwise this will take over your life.

        u will be lucky, the police dont prosecute because it could deter real victims from coming forward.
        Not to say it does not happen - cuz it does but very rarely and depends on the police force I guess. Beds police who investigated my case were useless, did not know what they were doing and let a blatant criminal get away with a crime.
        But as the others on this thread say - get over it and move on it is not worth being destroyed by it.

          getting over it for some is easier said than done! the nightmare of being falsely accused and everything that entails was bad enough for our son, but nearly a year down the road he is an absolute wreck, now seeing a psychiatrist and phycologist. Some people are stronger than others and just hope you have faired better than others.

            Hello DN2010,

            I am in a similar situation with my Grandson,after almost seven months I had a call from his solicitor yesterday morning to say the Police had refused charge and our nightmare was over,just like that,file closed,bail cancelled.
            The whole family were elated yesterday and My Grandson just wants to forget it ever happened,he was very lucky as all of his friends stood by him and he feels that his life can now go on as normal.
            However,I just don't feel that way and I believe there should be some retribution as I don't think I will feel closure on the awful situation that the girl has put the whole family through with her lies.
            I can't advise you either way,I know the sensible thing to do would be to try to put it all behind us but as witsend stated,it is easier said than done.

              thats good news M&w, right before xmas! we thought things would get back to "normal" once the case was NFA'd. oh NO. Not only are we battling to help our son I am full of rage that nothing seems to happen to these awful women. PLEASE before anyone tells me, i know negative emotion will not help, but it's just so wrong that they can get off scott free, especially in our sons case as we know she had done it once before.
