  • Recovering messages deleted from a cellphone

For additional details see the rest of my posts.

    Country of origin U.S.

The short of it is I had a cellphone (Verizon wireless LG VX 10000, stock/no additional memory, these types of phones do not have a sim card etc.) that was seized by the police via a warrant. I was accused of sending inappropriately messages. In actuality, the messages that would clear me were deleted from my phone.

Thinking about it now I should have tried to recover the messages before they took the phone but I never really considered it and I question whether the police won't accidentally lose them on purpose.

Does anyone know with any certainty whether the messages will be able to be recovered? I have read numerous posts on forums that suggest they will not but a few here and there that conflict, the last one is from the Verizon website itself.

We talked to the police recently and they essentially said that the only reason this thing has not been sent to the prosecutor to be resolved yet was they were waiting for my phone to come back from the lab which may take years.

In the meantime, the department of Children and Families put me on a list (i'm a pparently a danger to children now), without even talking to me, that I need to get off of to get on with my life. I need to go for a hearing at some point sooner than later and I'd like to know for certainty if I could tell them the texts are gone so they can stop hassling me or if I have to sit around these next years and wait for the police lab to do their work which I really can't afford to do.

If anyone has a definitive answer one way or the other I would be extremely grateful.

On a personal note, one of my friends did send me a risque picture before all of this happened, nothing he took or anything illegal but one of those pic/text messages that for some reason guys feel inclined to send to other people. I myself never forwarded it or anything like this but i really don't want the police getting the wrong idea about me if/when they find it

I understand that in the UK there is a backlog of mobile telephones in police custody awaiting forensic analysis. Apparently most criminals have three or four when they are arrested, then go out and get a whole lot more for the next arrest.

I was led to believe that due to the backlog it can take up till two or three months to analyse them. I am surprised that they have suggested it would take years. Are you sure that this was not hyperbole on the part of the police. In the UK we have legislation in the form of RIPA which means mobile phone companies must keep copies of texts for at least six months. Some do for a year. I have gently asked my solicitor to obtain copies of the texts directly from the telecoms company.

In relation to the embarrassing pics, expect them to be found even after they were deleted. Also the deleted texts should be recoverable for any forensic telephone analysts. Try googling it. There are a lot of companies out there offering the service. Not enough obviously if we are waiting months in the UK and possibly years in the US to have them processed. Probably a very good business to get into.

    Good luck

Sometimes deleted message can be extracted from the hard drive on the phone or the SIM, depending on where they are stored. In the UK your defence team would instruct a forensic analyst to examine the phone/SIM. Not sure what happens in the US.

Lg Voyager for Verizon Wireless don't have sim cards, some companies do require the phones to have sim cards and some don't.

I asked my lawyer if he could find out but he hasn't gotten back to me in like a month. Everytime I email him it costs me 150 dollars for him to answer so I've been trying to find out as much as I can on my own. I want to go to the Department of Children and families to clear my name and yell at them for awhile.

I looked at the specs of the phone. I believe that it comes with internal memory of 142 MB this is where the information including text will be held. You mentioned no SD CARD. unles you deliberately wiped it the texts and photographs should still be recoverable.

I found the answer I was looking for after a tremendous amount of digging.

I found a wonderful spreadsheet that details information about what information may be retreived from specific cellphones. It is in a word excel format and i'm wondering if it might be of use to anyone like rights fighter??? I'll be more than happy to send it to anyone if it may help.

If it is on a link then you should be able to post it up here.

Have you tried right clicking on it with the right mouse button, then select copy from the drop down menu. You should then be able to paste into the box.

                  Thanks

This company seems to be the top of the line when it comes to cellphone retrieval so I'd imagine this must be the standard for almost all else. I hope this might at least help someone out
