The short of it is I had a cellphone (Verizon wireless LG VX 10000, stock/no additional memory, these types of phones do not have a sim card etc.) that was seized by the police via a warrant. I was accused of sending inappropriately messages. In actuality, the messages that would clear me were deleted from my phone.
Thinking about it now I should have tried to recover the messages before they took the phone but I never really considered it and I question whether the police won't accidentally lose them on purpose.
Does anyone know with any certainty whether the messages will be able to be recovered? I have read numerous posts on forums that suggest they will not but a few here and there that conflict, the last one is from the Verizon website itself.

We talked to the police recently and they essentially said that the only reason this thing has not been sent to the prosecutor to be resolved yet was they were waiting for my phone to come back from the lab which may take years.
In the meantime, the department of Children and Families put me on a list (i'm a pparently a danger to children now), without even talking to me, that I need to get off of to get on with my life. I need to go for a hearing at some point sooner than later and I'd like to know for certainty if I could tell them the texts are gone so they can stop hassling me or if I have to sit around these next years and wait for the police lab to do their work which I really can't afford to do.
If anyone has a definitive answer one way or the other I would be extremely grateful.
On a personal note, one of my friends did send me a risque picture before all of this happened, nothing he took or anything illegal but one of those pic/text messages that for some reason guys feel inclined to send to other people. I myself never forwarded it or anything like this but i really don't want the police getting the wrong idea about me if/when they find it
