my 16 year old son falsely accused of rape by a woman of 40

I've just done a murder case, I am working on Peanut's hubby's CCRC application, I am working on another case (a guy who is being sentenced next week which I will attend if it is heard in the afternoon) plus other work I have stacked up.
Helping out on forums such as this is another way I try to help people. Most of what I do I do for no pay whatsoever. thankyou for your explination, which is all that was needed. some of us on here are not as knowledgable as yourself. i really appreciate your help but being abrupt can sometimes offend.
i know that you are deffinately right about the photograph which someone took of her, i also know my son is at risk of going to prison because they are claiming she was incapable of consenting to sex.
they photo which i speak of was taken around 12 o'clock, she went to bed and my son believes he saw her on the landing around 2.30 ish, may i point out she had had nothing to drink from 10.30 which is when i refused to serve her because she was being a pain in the backside flirting and anoying the men in here. she had nothing else to drink at the party either, that has come from the girl who went back to the house with her around 11.15.
everyone that night says she was very drunk, but being a landlady i notice things, i had a conversation with her at 10.30, she wasn't slurring her words she wasn't staggering around she was just making a nuisance of herself, and i could see my customers and there wives getting annoyed. if i'm honest i wanted her to leave then, our pub is a very small village pub with never any trouble and i had the foresight of her causing some!!
i accept any help you may have to offer, i was mearly trying to explain no photo's had been taken other than that one. my son and his friend were the youngest at the party, most were in their 20's upwards so it wasn't like a kids party. there is a couple that were on the landing most of the night but saw or heard nothing. they just noticed her door open then shut inbetween them gpoing up and down stairs a few times for drinks etc.
i already fear my son is doomed, i came on this sight for help. i suppose offended was not the word i just felt reality had hit me in the face.

I know that it's difficult to stay positive, but thinking your son is already doomed probably is not the way to think. YES i know how difficult that is, we always seem to think the worst. You know your son better than anybody else, you know he couldn't have done this awful thing so now you have to find the strength to help him fight this. If you don't believe in him who will? Try not to be offended by the advice offered on here, people truly are trying to help in the best way they can, and if you are armed with information that will make you more powerful. Remember "Knowledge is Power" Try to keep strong love, you are in my thoughts.

Landlady, you son is NOT doomed. Please try to look at the positives. It's hard I know, but there are positives to the case. You have witness statements who say that they don't believe this woman. Gather some character references - ask his teachers, your friends, his employers to write a letter detailing his personality, stating that they believe he is a good kid who would not commit such a crime.

also the act of completing a timeline can help you remember more details. for example you might suddenly remember that you asked your friend had to leave to get the last bus home and if you check the bus timetables for that route you can find out the time or you might remember that the pub had just closed, it was last orders etc..."I dreamt I went to the doctor's and she gave me eight minutes to live. We can all understand your anxieties, this situation is just awful. Please remember that you are not alone in going through this ordeal and we will help to the best of our abilities. Some of us can only offer the preferbial "shoulder to cry on" others can offer legal advice. If you genuinely don't understand something somebody may be able to explain it in easier terms. Dim! A member of the group I run - her young son was falsely accused of rape. This was in Northern Ireland. The barrister tried to get him to plead guilty (saying he would get a lesser sentence) but the lad refused to do so.
Barrister told him that he was looking at a very long sentence, that he WOULD be found guilty so might as well plead. He refused to do so. He was found NOT guilty by the jury.
Had he taken the barrister's advice he would be sitting in prison now with no hope of appealing that conviction, due to his guilty plea.
Your lad is not doomed until the verdict - and we are being previous here, as I understand it he has not yet been charged.
Largactyl's advice seems to be extremely helpful in relation to various medications and their effects. Should this matter progress I would suggest you copy and paste her advice to the solicitor.People Appealing Convictions of Sexual Offences ~http://www.pacso.co.uk

just to ley you know my son has been charged after 9 months answering to continuess bail. this was done in oct.

i'm sat here going through all the papers and have noticed that some of the forensic swabs that were done have no result papers with them, i.e the nail swabs, anal swabs, is this beacause we have not been given them yet or is there no results to be had?
there are 8 of 8 papers all refering to vaginal swabs and their results.
it is worrying me because she has said he tried to force her to do oral sex and anal sex. so there being no results makes me wonder what they may be expecting to spring on us at a later date, thats if they can do that at all.
i wish i knew more of how this legal system works, as i said before our family is completely new to all of this and i find myself out of my depth.

I would suggest that these were inconclusive so are probably in the "Unused Bundle". What is in the "Unused Bundle" can sometimes be very helpful. This is made up of paperwork which could be witness statements made by witnesses interviewed by the police, police statements, custody records, all sorts of stuff that is not helpful to the Crown, and could actually undermine their case.
Also you might find reports from experts, or a "schedule" which is a list of unused stuff that they may not disclose but the Defence can apply for. So if you do not have the "Unused Schedule", ask if you can have a copy of it.People Appealing Convictions of Sexual Offences ~http://www.pacso.co.uk

may i ask one other thing,
on the forensic report it says,
MIXED DNA PROFILE OBTAINED FROM SEMEN FRACTION FROM AT LEAST 3 INDIVIDUALS.
HERS, MY SONS AND A SINGLE UNCONFIRMED ADDITIONAL MINOR COMPONENT.
her lover gave a mouth swab with his dna, and she admitted to having sex with him on the friday, but surely they would have named him as the third unconfirmed dna wouldn't they???????????
my line of thinking is who's dna was it if not the lover and can we find out either way??????????
