my 16 year old son falsely accused of rape by a woman of 40

    Bipolar

    Hi Landlady, just been reading your original post where you say this woman has Bi-polar.
    I have severe bipolar and I am on medication (a lot). If this woman has genuine Bipolar then she should NOT be drinking on medication - it can change behaviour and also cause blanks in memory. I never drink anymore as I found out the hard way that booze and meds don't mix ( a bloke laughed and pointed at a friend of mine so uncharacteristically I walloped him), I also found I had breaks in my memory even when not drinking vast quantities. This would undermine her statement considerably. A lot of meds for Bipolar specifically warn about not drinking excessively.

        this woman has told the girl that was her friend that forensic examination done at the rape crisis center showed a vaginal tear!

        So we do not actually know for SURE that there is a vaginal tear do we? All we "know" is third party gossip.

        The accuser is a woman of a certain age and possibly, from evidence received, is rather promiscuous. That being the case then even with little or no foreplay - pardon the crudity, but she is going to be "loose" in a certain area of her body anyway.

        Try not to listen to what a "woman has told the girl that was her friend" has said........

        Wait until you see the medical report.

          Another thing about Bipolar

          Hi Landlady, there are other things about the strange condition that is genuine bipolar and any psych can back this up. When in an active phase of the illness, again it is very difficult to build new memories - hence I have little memory of being hospitalised whether on an up or a down, or even when becoming acute because the brain can't "hold onto" thoughts and thus store them in the memory banks. Your brain is either going at a million miles an hour ( on a high or a mixed state - i.e high and agitated but low mood), or on a low you don't really think much except dwell on bad (real or imagined) things.

          I don't know much but if I were on mastermind, my subject would be mental illness (and I guess education as I was a teacher before I became too disabled by this illness)!

          I won't bore you too much now but moodstabilizers (particularly the anti-seizure ones - same as for epilepsy) should not be taken with much alcohol if any. Sedative neuroleptics (more often known as anti-psychotics) should definitely not be taken with alcohol - people with bipolar are almost ALWAYS given sedative anti-psychotics because of the nature of the condition. Some people with bipolar are also given anti-depressants - again almost always sedative ones (non sedative ones can bring on the manic phase).

          Another thing, when a person is entering a manic phase of the illness (or is naturally at the high end) a person becomes recklessly horny - and I mean seriously so. Equally, when a person with bipolar is in a low phase, drink can start to emulate a high (the brain can lift mood for a short time when you are dragging in the low-end) - again reckless behaviour - but followed by a crashing depression ( any bits of serotonin kicking about in the brain having been totally exhausted). Again, memory blocks can occur throughout.

            If i have understood this correctly, then the "incident " happened in Nov and your son was not arrested until end of Jan. If that is the case, then there should be no Dna evidence or photos etc as it would all be long gone.
            My advice to you is to go through all the evidence, especially her statement and look for things that seem wrong. It is a horrible thing to have to do, i hated it but it produced so many things that we could challenge that it was well worth doing.
            Read everything and question everything, look at the times, my sons accuser insisted that they arrived at his house at 21.30 played on the computer for 30 mins, watched tv for an hour then went to bed at 01:00, my son said that they went to bed at 23.30
            as they say, the devil is in the detail. If you need help we are here and feel free to ask questions, if you need to PM us.
            I suggest that you read Police and criminal evidence act, regarding what they should do, also ask your sol what you can do to find more evidence, has she sent texts, any criminal convictions, simple google of her name can turn up all sorts of things.

              RF is absolutely correct - we have only heard 3rd hand about this so-called "tear". Often false accusers will embellish their "ordeal" to friends in order to gain maximum sympathy - the "rape" was so brutal that she tore! How dreadful for her, etc etc.

              Try not to worry about the forensic report until you have seen it.

              And absolutely excellent advice from Jen. You absolutely must instruct your sol to request this woman's medical records, It is almost certain that the first request will be denied, but your sol can make a special application.

                If this information is proved to be a lie then this can be put to the accuser at trial as to where this rumour came from. The person who told you about it would have to give evidence so that it can then be used for the Defence case to prove she lies.

                  hi there,
                  it happened at the end of nov 2009, she went to rape crisis center the day after, vaginal swabs were done which show my son dna on high vaginal swop, she did not go to police for 13 days after this! they did not arrest my son till the 30th of dec, she has sent txt messages to the girl who's house it were saying she was not going to the police! there are also txt messages on there from when she was on her way here that night and that she was on the bus already "pissed"!!

                  that phone was taken by the police and not been returned since june!!! the girl who's phone it is is still paying her contract on it!!!

                  as for times, everyone that night was drunk when they left the pub, except my son and his friend. no one seems to know times much really but joe is adament he left around 4.30. he by this time had had quite a bit to drink, all bought i might add by the woman who's house it were, who by the way is a youth offender worker!!! yes giving under age kids booze,,,,, nice woman!!!!

                    well tommorow is my sons first court date in the majistrates court, he had councilling today to try to help him through it.

                    he is so scared, i'm so scared.

                          You will be amazed at the strength that you can find to fight this. I wish you well, Crown court is the worst part, waiting for a verdict. Hopefully they will realise that this is rubbish and you will be spared that part. I was literally shaking waiting for the verdict. Good luck, i will be thinking of you Kev

                                Hello Landlady, it has taken me a few days to express my feelings towards you in a way in which you and your family can take comfort.

                                The ordeal in which you are all going through is living hell and you will all think is there light at the end. I am no legal expert but recently I went from being happy go lucky to being accused and over night I was destroyed and my loved ones have been broken. It's left me with massive legal bulls and now in therapy for the effects it has caused.

                                What can I offer really that would help, have faith. When you listen to all the facts your be thinking oh my god what an earth do they mean. With cases like this they dramatise and use terms that strike the fear of god in to you, when inturn it's nothing to be alarmed about or worried by.

                                Your sons liberty is at stake and it often will be hard to separate your own fears and that of a caring mum, your be left wanting comfort from your partner.
                                My advise with your son who is so young to be going through this ordeal is to understand that although he has had sex and can be classed as a man, he is still a boy that does not have the life skills of a older person.

                                The Court system is daunting, often surrounded by toffs that don't have true understandings of the real world. You need to sometimes step back listen before you come back with your answers. The prosecutor for the cos will do all they can to juice the wording up, often making it out the poor victim suffered such trauma from the events. You may become angry and want to burst out saying lies. Don't. Just keep notes and pass this to your legal team.

                                Be strong and come back to the site. Vent your pain, anger in here. We have all gone through similar.
                                Chin up and pass my regards to your son.
