    If they have no evidence at all, they may not have evidence to prove she was lying. So if you have any evidence to support you claim she lied. Texts, facebook messages etc then have it vetted by your solicitor, then contact the OIC and say you which to make a complaint against her as she you believe she has PCJ. It has to be the OIC that deals with it. They have to take your statement and cannot refuse. They should take your evidence and a statement then decide if they can open a case. They may actually open one but if they don't you can then ask why and if there response is not good enough you can then complain through whatever is your local process.

    I gave evidence to my OIC a Detective Constable, who tried to fob me off, then she said she had to talk to her superior which was Detective Sargent who said that I would get a letter from the Detective Inspector. I got a letter from the DI saying they were not opening a case but I phoned them. He did not know I gained access to the FA's statements so i knew where she lied and knew that they police had found contradictory evidence. I said this to him on the phone but he still refused to open a case, so I have made a complaint to the police ombudsman. I have not had much success with them but hey I am not giving up. You know in life if you complaint to Joe Bloggs, who usually deals with complaints, who then passes it to their superior Jill Bloggs, who then passes it their superior John Bloggs who phones you from home on his day off that your complaint has legs.

    So DON'T LET THEM FOB YOU OFF, educate yourself, be professional, be prepared, be determined.

    I say yes police knew she lied my solicitor reckons so too thing is it's over yes I.ve had hundreds of support many more too she was slammed by hundreds that didn't even know me as she posted on facebook in public stating she had a call nfa no evidence at all yet she still tried to twist her way thro but people saw her lies straight away

      Asking the same question or saying the same thing won't necessarily give you the answer you want. Well, it might but that doesn't mean it will be the right answer for you.

      I've been doing this work for 17 years now and I've seen dozens of cases where there has been a NFA, where it is clear nothing happened at all, but the police have still refused to prosecute the complainant.

      To sue somebody would cost you a huge amount of money - there is no legal aid for it. If the complainant has no money or assets then you aren't going to get anything from it, after paying for the case to be heard. You will lose out totally. As Pond rightly says, It's civil law not criminal.

      Also as Pond rightly says, some police forces have policies whereby they will not go after a false complainant. Also Pond is in Scotland, and the rules / laws are different to those in England and Wales. He might get some semblance of success (and I do hope he does) if the police do prosecute her for intending to pervert the course of justice, and conversely, he might not get what he needs for closure. It could still end up going absolutely nowhere.

      I've known men in this situation spend years and years after the NFA or NG verdicts trying to "get justice" and they rarely succeed. All those years wasted when they could have been doing something useful, worthwhile and enjoyable.

      The person who got me into this "business" was a friend who was put into prison by his daughter. He came out on appeal in 2001 - after 8 months in prison. He refused to let it lie. He's tried to go after the police, Chief Constable, MP and everyone else who he thinks has caused him problems. None of it ever worked and it's only this year - nearly 18 years later - that he has finally stopped running around in circles trying to get "justice". He did get it in one way - he was released on appeal. Very few people in his situation get to do that.

      He's wasted all those years, winding himself up, to the point of going through numerous psychiatrists and psychologists, all sorts of different medication, booze, when he could have been enjoying life. He lost most of his friends because they all eventually got totally fed up with it all through all of those years. It just wasn't worth it in the end.

      Kimmy, what you try to do is entirely up to you. But please do not expect it to come out the way you want it to. You could end up with absolutely no money and no friends at the end of it all, if you go down the same path my friend Rob did.

      Good luck with it all though if you do decide to carry on with it.

        Hi Casehardened

        That was a very good post. I know where you are coming from. I am not seeking revenge or money just a change in the thinking of the police and prosecutors.I am not going to spend years on this. It would have already been mostly over if the FA had not decided to accuse me of harassment. I know at which point I plan to stop and it most likely is only months away if not weeks.

                If there is only one lesson I have learned, it is to listen to Rights Fighter. You may detect some of her wisdom in my posts and I will give all the credit to her. If I couldn't fall back on her advice and vast experience I couldn't be here at all - Casehardened comes a pretty close second though.

                Pond is in Northern Island rather than Scotland but the point remains, while he is himself a wise and clever man, the emotional trauma and sense of injustice can over take us all - but forever going round in circles as RF describes is surely a victory for a false accuser - You may never get the justice you deserve and while I would never advocate that you shouldn't try, I will always stress that you can live with being falsely accused and there will be a day when you realise that you haven't thought about it at all. Hasn't the accusation already taken up too much of your time? What about what you would have been doing if none of this had happened?

                  I do wish there were "like" buttons in this forum! Seeing "PPS" as opposed to CPS, there was me thinking it was Scotland when in fact I know he's in NI. I can't blame the booze this time, so I will blame my age!
