    Case goes to cps this week I beleive

    The case gets sent off this week, does anyone know how long it usually take for them to get back with an answer? I am going out of my mind here it feels as if I might aswell be on death row! Waiting for the hangman to call out my name this is the worst feeling in the world.
    I keep telling myself everything will be ok, but there is always that doubt!

      It'll take as long as it takes. There is no set time limit, yours isn't the only case that they'll be dealing with, so its a case of sitting tight and holding it together.

        3-4 weeks

        3-4 weeks is what the DS on the case said to me today on how long it will take for an answer from CPS, is this the norm?
        what is the likelihood of hearing anything sooner?
        I am due to appear for bail on the 29th, should I expect to be re-bailed?
        I just cant see how I can be charged with this????
        My friend and I both giving the same statement, my friends friend staying over who's statement pretty much marries up with mine.
        No sign of any physical evidence so far, as I am certain I would of been charged at the first scrap of anything that would come up, am I right???
        her statement pretty much saying she cant remember anything from leaving the bar up until leaving the flat.
        CCTV of her leading ME! up the stairs by my hand, and vice versa of her leaving the flat perfectly able to walk on her own!

        This is the most stressful and horrible situation I have been in!!!!! there just doesnt seem to be any light at the end of the tunnel!!!!!

            the answer is - nobody really knows.

            The CPS will have many other cases to look at besides yours, if they haven't finished looking at it, then they will keep re-bailing you.

            But you could turn up on the day to be told that there is no case to answer.

              I hope and pray that this is the case I keep visualising the scenario of " no further action required" also I visualise the opposite either way I just need to know!

                    Thanks for those links casehardened, very good reading and does add a bit of relief to me.

                    I think the last link you put up is absolutley terribble! how can that woman live with herself! she should be tried with involuntary manslaughter or something!

                    From everything Ive posted could anyone see anything such as lesser charges being brought.

                    With no physical evidence its just a case of proving consent right?
                    I hope this gets ended soon so I can get on with my life!

                      It depends on who puts on the best show on the day - never ever think that its about truth and justice - because its not.

                        if the CPS listen to the judge and they should then this will help all those not yet been through the CPS thing - I agree that this is not about justice its about who do you reckon will be believed in court if at least some evidence exists - so if you admit nothing and there is no evidence and the CPS listen to the judges comments - then this helps.

                        The new government wants change in the system and is much more for law and order rather than guilty men must all be punished - so if this starts to filter through it will help but this all takes time and I wouldn't expect any big changes for a while.

                          It is entirely down to the credibility of the witnesses and who the jury believe.
                          There may be no physical evidence, but that doesn't mean the jury will not believe the "victim".

                          In our case under cross examination from our barrister, the accuser admitted that she'd lied about how much she'd had to drink and she agreed that she had taken her clothes off and got into bed knowing full well my husband would be going to her room. She was also shown to have lied about how the door to the room was locked and unlocked. She also admitted that initially she had claimed she'd been raped, but later changed her mind, and claimed she had been indecently assaulted. Unfortunately it seems the jury didn't pick up on those lies, because they believed everything else she said.

                            Does a judge get involved in any cps decision? Will they run it by a judge before making a decision?

                              I doubt it. Most cases wouldn't reach court if the cps allowed someone with a brain to look at it.
                              That's probably why they don't.
