Update

Been back to the police today to answer bail. The rape allegation has been "No Further Action"ed and they are waiting for the CPS to decide whether to charge me with the assault on my daughter. I have to go back on 6th January 2010 unless I hear from them before then.

That is all very good but it works both ways - the person who accused me got off free as she claimed "she was off her trolley" and hence avoided prosecution. Which gives her cart blanche to make further allegations in the future knowing full well she is above the law!!!

Even though I wonder if she had of punched some one in the street would she then of been prosecuted, but when it comes to perverting the course of justice which carrys a life sentence she blatantly got away with!!!

But I guess I got justice in the end and people who tell lies it comes back to haunt them, the baby she was pregnant at the time is at the moment sitting in his high chair watching CBBC. The baby she went to extreme lengths from stopping me from seeing him before he was even born is a baby she will be lucky to see 6 times a year! I wonder what the greater punishment for was
Going to prison for a year for perverting the course of justice or losing the thing she wanted the most. All she did when she made those allegations against me was to strengthen my resolve and not weaken it.

So this is a story to anyone who has been a "victim" of horrible lies they will lose in the end.

I am not sure where you got the idea that perverting the course of justice carries a life sentence but

General sentencing brackets summarised in Archbold as follows:-

• threatening or interfering with witnesses 4 months to 24 months.
• concealing evidence 4 months to 18 months, possibly longer if serious crime.
• false allegation of crime resulting in arrest of innocent person 4 to 12 months.

Sentence should normally be consecutive to substantive offence.

I would be interested however to see any evidence from an official source that one can get life for PCJ, just for my own records.

Perverting the course of justice

In English, Canadian or Irish, perversion of the course of justice is a criminal offence in which someone acts in a manner that in some way prevents justice being served on either themselves or on a third party. Perverting the course of justice is an offence in common law. It carries a theoretical maximum sentence of life imprisonment, although no sentence of more than 10 years has been handed down in the past one hundred years.

But the day after I was arrested the DC told me she would be charged with wasting police time - in which I told him that was not good enough and it was peverting the course of justice. In the event I think the police let her get away with it and the story she told was so untrue it had to be that and they would be laughed at for investigating it so they just brushed it under the carpet to save face. I still think it is wrong that a D/S made the decision not to prosecute when it should have been down to a judge to decide if she broke the law intentionally or it was down to mental health issues! - a very un fair system

The police wrote to me 4 months ago now saying they had passed it to an auditor to decide if it was no crime or not but have not heard anything since.

I guess I have just been CRB'd for some voluntary work I am going to do - would be interested to see what shows up I guess.

Can you post the link up for that please as it seems to be completely different to what it says on the CPS site? Mind you maybe the sentencing on PCJ on there relates to false allegations of rape and sexual abuse in general so maybe it depends on the subject matter.

This is the link - surely the worst crime in my mind is a false allegation of rape as it is so one sided - a man can not accuse a woman of the same thing.
As a man would face several years in prison - surely the woman should face the same sentence as the man would, But I guess that has been discussed many times on this forum.

I don't trust Wikipedia unless I recognise who actually writes the articles. Anybody can post up "information" on Wikepedia and it doesn't mean that it is accurate.

I'll have a look on other sites (and maybe you could too) such as Law Society, Bar Council etc.

The police have only just finished the case against me so I have no idea at the moment if they plan to charge the accuser or not. I will keep you updated once I know.

It has been a long and painful few months but I am so glad it is all over.

Great news! I hope you can now put this all behind you.
Don't be surprised if it takes you a while to start feeling "normal" again. Often people carry the emotional trauma with them long after the ordeal is over. In fact I am not even sure what "normal" is any more!
Have a cheeky glass of something and congratulate yourself on having the strength to have survived this! You deserve it!
