sorry its been a while, all your advice was very helpful. I am not sure if you can Help with some advice on D Cat. Would my husband be entitled eventially to D Cat. Do you know if he would be able to work and have home visits etc. He has to serve 3 years, he is C Cat at the moment, when would his review likely to be? Sorry for all the help you have given. If anyone has any info on Little Hey it would be appreciated as that is where he has been allocated a place but not yet moved. We are still fighting for him, he is struggling serving a sentance for a crime that he did not commit....

I doubt he will be sent to a cat D, they're used for those deemed low risk from the start or by those on a longer sentence who need rehab before release.

RFLH is right - as hubby is protesting his innocence he will be deemed too much of a "risk" to be sent to a D cat prison.

From what I have heard Littlehey is not as bad as some C Cat prisons. Why don't you just Google HMP Littlehey?

Hi evryone i am new to this but didnt know where to turn, my husband of 10 years has been faulsly accused of attempted rape, he was at a party with a mate when a fight broke out he left the party with his mate and another girl from the party ran after him and demanded he went back to the house and get the drink which cost her 60 pounds, when he said no they got into a heated argument and she started kicking into his legs he pushed her away and walked home 2 weeks later the police lifted him from home and he has been remanded in custody for 110 days he was not granted bail as he had previous convictions from around 15 years ago but hadnt been in trouble since, the girl is now bragging on her social network site that she has no intentions of going to court she is just letting him sweat for knocking her back i have had to move from the area as i cant cope with the roumours he has a solicitor and a advocate from edinburgh a frances connor who i hear is very goos but i have had no support from anyone and dont know where to turn thanks for reading x

You say he has previous. May I ask what the previous is, without you having to go into too much detail?

Scots law is different to that in England and I don't think we have anyone on this board who knows much about that.

So it is completely unrelated to what he has now been accused of.

I have to say I am surprised that he was remanded into custody on the grounds that he has unrelated convictions that go back to when he was a kid.

Make sure you save/print out - the claims that she makes on the sites - this will add to your husbands defence.

yes i have printed them out and my husbands solicitor has them can they use this in court ?

Printing them out is not real evidence. You need to save "screenshots" and then ask/politely request the appeal solicitor if they can instruct a forensic computer expert to examine the hard drive on the basis of the screen shot.

RFLH is correct in that evidence from networking sites is becoming commonly used as evidence. It has to be done though using certain procedures.
