  • Falsely Accused but a good Police officer!!

    I have read some of the posts on her about how people have been treated and have to count myself lucky in my story. I did a lot of work to get the police on my side. Rather than lots of phone calls I put lots of things in writing. So I wrote to my MP, Chief Constable of Surrey Police etc. At one point the DC assigned to my case was taking a long time to get in witness statements so once again I wrote to his DI explaining that I was worried about peoples memories fading and he was assigned another police officer to help with statement taking. As evidence started to build I made an agreement to speak to them every other Friday shift patterns allowing so I did not make a nuisance of myself. This worked and as evidence in my defence built they started to call me and update me on the progress. I only came off bail today 15th August 09. Meetings are being held as we speak with the CPS to create the charges and I will be with the police to sign a statement for this next week. Writing to your MP is a great thing to use as it filters all the way down the chain of command and you will be treated with respect. Last and most important thing is make sure you are not regarded as a pest.

    Below is my story:-

    I'm 38 years of age I met a girl 3 years ago and foolishly left my wife to be with her. We rented a house in Surrey for the last 2 years. The relationship was not working out as I found my partner had issues mainly an obsession with animals. I had tried to leave her on a number of occasions but was effectivly blackmailed because she had attemted suicide in the past.

    My ex wife had been blocking my access to my children for the last 9 months and I had a date for court in June 09 so on the 6th April 09 told her it was over. The property cost £4000 per month so I told her that I would pay 2 months rent and leave my deposit on account for her so a total of £12,000. She wanted me to pay 6 months and I said I could not afford that she told me I would be sorry.

    On the 10th April 09 she went in to the police station and accused me of rape but asked for nothing to be done until I moved out at the end of June. She came home cooked dinner and acted as if nothing happened. The following day was easter sunday and she even had me thank her mother for my easter egg. On the 28th April 09 I had her arrested for the theft of some laptops that held NHS data she was arrested and told not to return to the property. The next day she came in through a window and I called the police again the police spent 2 hours trying to get her to pack and leave the property was in my name and so were all the bills. She made an accusation of assualt and I was arrested this charge has been dropped that evening whilst I was at the police station she made a call to the charity crisis she got an injunction stopping me from going within 100 metres of my home. It was not until the 5th May 09 I was arrested for the allegation of rape.

    The next thing she did was to start causing criminal damage my Porsche motor car was vandalised and an axe was put through the windscreen and every panel was keyed. I got an injunction to stop her selling my assetts and allow me to collect the Porsche, BMW motorbike and a collection of paintings. When i got to the property with the police the items were gone even with the court order. She had my ex wife hide the car and bike and these still have not been recovered. Every item I own has been destroyed and sold off. A number of people have come forward saying that no rape took place as she has told a number of people. She also had tried a different plot to have me arrested in Jan 09 as well and these people have also come forward. All my items were loaded in to her horse lorry with the assistance of my ex wife and taken away the police have executed a search warrant and found one items that was taken and sold to a local farmer. She also had her old boss charged and found guilty of ABH back in November 08 so the police are looking at this case also due to the similarities. They are now looking at fraud, 2 counts of perverting the course of justice, theft the list goes on.

    Its believed that she has had someone charged with rape at University as well. I'm bailed on the rape until the 15th August and they have also set her bail date for the theft and fraud as the 25th August also. Her bail has been extended and the officers working on the case this week have been to the CPS to prepare her charge sheet.

    I'm confident she will be charged from the conversations I have had so far. I have to admit I lost my home and job so this has been extremley stressful as I lost everything I own in the world at the same time but you must stay focused and be calm at all times with the police if you want to get them onside. If you write a letter to an MP be complimentry to your officer and never make it a complaint against them. When you have too much time to think take up a new activity I have been in the gym for 4 months now and look totaly different.

    Last of all speak to people about it you did not do anything so talk about it to friends family the lot at this time friends are vital.

    I am speechless. Such rage and nonsense from your ex, and your ex-wife! It sounds as though hopefully common sense should prevail in your case, (I'm assuming you haven't been charged yet?) but you ought to take some steps to protect yourself just in case. Have you got a sol on board yet? Make sure you choose one who has a *proven* track record of *successfully* defending these types of cases. It is unlikely that they will be able to do anything unless you are charged, but it is best to be prepared.

    If you are bailed until the 15th, then today is the day you answer bail. PLease let us know how you get on!

      No need to attend.

      I was told there was no need to attend today and I'm not being re bailed. The officers for the theft of my stuff and the rape have meetings with the CPS next week Wednesday I have had to prepare a statement which I will go and sign on the allegation I made for the theft of my stuff. I did select a specialist solicitor but been told not needed and should not be needed. I'm positive they are intending to arrest her and charge her with a list of offences especially as she has done something very similar before and one of the officers was involved in that case.

        So does that mean that your case has been NFAd? My understanding is that Charges have to be brought face to face. If you have not had to attend bail, and bail is not being extended, then that must be good news.

        I don't wish to denigrate your ordeal in any way. However I must stress the following:

        You are clearly a well-educated, affluent person. Many people who are falsely accused are neither, and the thought of writing to their MPs would never occur to them. Most people, whether well-educated/affluent or not, tend to have blind faith in the "justice" system, believing that the truth will prevail. (I include myself and my darling man in that!). Your advice is therefore incredibly important. I hope you will keep us updated on your story, and be here to support others who find themselves in a similar situation.

          Fantastic news and your post is a lesson for anyone who finds themself in a similar position. Surprise isnt the word Id use, as you prove cases can be dealt with in responsilbly by the Police - if you force them into a corner. The one thing many of us would argue is that the Police didn't take any extra statements - unless they thought it would help the accuser.

          More and more people are no contacting MPs and in some cases it proves to be a very successful exercise - atleast the Police are aware of being in the spotlight.

          I still dont see how anyone could be charged when the evidence does not support it, as it indicates the Crown think your guilt and can gain a conviction at trial. To say a good Solicitor cant be of assistance before being charged is strange, after all there purpose is to defend you, therefore to challenge the grounds of the charge against the evidence being used to secure it. Cos the reality is charge = guilty = court = trial = guilty until you prove your innocent, when the evidence already available proves you are. It should not take a jury to confirm what the evidence already proves

          A contradiction in terms and waste of tax payers money !!! FRAUD by disception on the part of the CPS and CRown.

            Today is a great day!!

            Well today my living hell has officially ended. My x-girlfriend was finally charged with perverting the course of justice last week. She is still maintaing that she was raped but her interview lasted 16 hours and they had so much damning evidence she eventually broke down into tears.

            So in my case I lost my home, job, access to children car smashed to pieces and insurance refused to pay out every single item in my home was stolen. But I'm still here and just started a new job after being out of work as result for 6 months.

            Its scary that a girl can just walk in to a police station say she has been raped and in the case of family law they have something called the law of probability "basically you are guilty until proven innocent" so the judge gave a non molestation order stopping me from going home even though the house was solely in my name along with all the bills.

            To add insult to injury now she has been charged I go back to court to get the order annulled the judge refuses saying she is effectivley a tennant and I need to follow that procedure which will take a minimum of 2 months to get her out. So even when found out to be a liar the guy still gets screwed over and left on the streets. So I have to spend Christmas in alternative accomadation whilst she carries on stealing from my home and living it up for free.

            The good point however is I'm sure she will go to prison for this. So all this happened because it was my house and when we split I wanted her to leave.

            Moral of the story be careful who you let move in with you.

              CPS and the Crown are the same authority!

              Remember that boys and men make false allegations of abuse too - just as much as girls and women. Males tend to make them in care home and school scenarios although some do so in the domestic arena too.

              It's a shame you can't name and shame her out of the property.

                I agree that boys & men can make accusations I used to be a foster parent and had a lot of experiece with safer caring policies. The thing that I could not understand is. If I was raped in a house its the last place I would want to stay in. I would do my best to get as far away from that place as possible.

                In the case of my x it was all a tool for fighting to stay in a house and a way of life. Even now I still dont understand how with no children and she had only lived with me for 18 months a judge could make a life changing decision like this without me even being present at the hearing. Leaving me with huge financial responsibilities and being made homeless.

                Even now my feeling is I should have walzed in to court and had her evicted immediatley. Thats exactly what happened to me at least she knew she was going to court to be asked to leave.

                Anyway as my family keep telling me at least I'm in the clear and my nightmare is ending hers is just begining.

                  Is there no way of appealing the judge's decision?

                  I don't know much about family law so I can't really help in that regard.

                    Not really I just have to look on the bright side and say from the 18th Jan 2010 I will get my house back. What state is completely another matter though.

                    I have learnt about family law the hard way and the system is there to protect vulnerable women and the sad thing is when there is a crazy guy involved its no use we all hear the horror stories on the news. The problem is when a female knows how to play the system the male has no protection.

                    Judges always play on the side of caution so will take the females side. To be honest if I was a judge I would hate make a decision and something happens to the woman I would not be able to sleep. I can see both sides to the equation but it does not make the pill any easier to swallow when you are the victim.

                      I am so pleased that your false accuser will be charged. You might find it offers you a degree of healing. An NFA or a Not Guilty does not mean the end of the ordeal.

                        Hedgecroft, I'd like to talk to you about the situation you found yourself in, as I've had the false accusation with the police & CPS subsequently deciding NFA. I don't want to tell my story yet on a public forum, as there are still elements of civil litigation I don't want to prejudice.

                          Please do keep us updated Hedgecroft about this. It will be very interesting to see how it goes and if convicted, (hopefully she will be) how long she will get.

                          There was a case in the news today where a guy was given 12 years for planting CP on a colleagues computer - he was done for PCJ. Most liars who are prosecuted for that tend to get around 6 months and I think the most I have seen is 3 years and released at the half way mark.

                          Hopefully the sentencing judge will make an example of her.
