  • I've been falsely accused of sexual assault and await a trial

    I'm not sure what I can and can't say since the case is due to be heard in the coming months but my life has been hell for the last few months with the trial hanging over me, I feel as if I'm being treated as if I have done something even though I haven't.

    To my surprise my previous solicitors said they believed there was enough evidence for the accusation to go to trial, which I completely disagree with, first off I can't see how there can be evidence when I've not done anything but secondly they are supposed to be representing me and it felt like they weren't doing anything so I dropped them and went with another firm. I would have hoped that the whole thing would have been thrown out before it even gets to court but I feel like the first firm didn't do anything and the second firm aren't doing anything either. I have enough proof to show that on at least one of the ocasions I wasn't even there when the person accusing me of sexual assault says I sexually assaulted her, and I've got evidence to disprove the other events she is claiming, but I've been told I'm looking at 10 years behind bars if found guilty. I don't want to name the firm I've with now as they read these posts and don't want to risk my defence.

    I've already done most of what is on the list before I even read it, the only thing I haven't done is looked for a barrister and wouldn't know where to start. Just knowing some barristers to ask to represent my case would be a good start I guess.

    Can someone please offer advice on how I can get someone to consider throwing this out before it even gets to court as it is a ridiculous claim that even the Police know is rubbish but are having to follow strict procedures due to the prosecutions claims of disability which again are lies.

    Because the sols said that there was enough evidence to go to trial, doesn't mean that they think you are guilty.

    "Evidence" can be anything from the allegation itself, and what other people say, for instance, if she claims she went to her mother, or a friend, family member, doctor and told them what she alleges has happened, and they make a statement, that is "evidence".

    If there is DNA evidence or medical evidence (if violence was alleged for instance) that is classed as further "evidence" regardless of how truthful it is.

      Once it gets to Court how much weight does what she told someone else carry. Is that not hearsay rather than any real proof?

      The more I read on these forums the more I worry for everyone falsely accused.

        What a complainant tells another person is hearsay - yes. The judge has to direct the jury that this is not evidence that the alleged offence occurred and it only serves to provide consistency, if it does. For instance, if the accuser says she told a friend one thing, and that changes to what she told the police, then the judge would flag that up as an inconsistency.

        It is only evidence that emanates from the complainant. In other words, it is 'evidence' coming from the complainant, not evidence as to what is supposed to have happened.

            Put it like this. Words are "evidence". Words from a complainant, truthful or not. Words from a recent complaint / first complaint witness - truthful or not.

            It's really difficult for both sides, if you think about it. Most cases are genuine and most genuine cases only have words as evidence, unless there is medical or DNA evidence as well......

              Thanks for the clarification, I still think my previous solicitors could have done more which is why I changed them. I would have expected by now for the whole thing to be thrown out before it even got to court, but I'm still here almost 2 years down the line with a court case to attend.

              My wife keeps telling me not to worry because the accusers story changes each time she mentions it but that is what everyone keeps saying, don't worry, but I am worried, not only because my liberty is being threatened but the impact this is having on my wife and child is enormous, and it isn't fair for any of us.

              The case is listed for next month and I still don't know which barrister will be representing me and still haven't had a conference call, I just wish my solicitors would do more.

                  I'm at a state of desperation now, counting down the days, all I need is a good legal team to represent me. I'm fairly certain I have enough to prove my case in court but I need a legal team to hold my hand. All I've seen since the allegations were put in place are barristers turning up and telling the judge they don't know what is going on and then when the judge asks them questions all they say is they can't answer any questions, and all I've ever wanted from the start was a barrister to represent me throughout the case so that the barrister knows the case inside out.
