  • Police Investigations into Historic Abuse

    Hi all,

Apologies if this has already been covered but I've had a look and cannot find the answer in the group.

Can someone explain what happens when the police investigate historic abuse cases? It just seems that 8-10 weeks is an awful long time. I understand that the police will have multiple cases as well and things just dropped on their desk. But I'm just curious to know what they are doing, who they are talking to etc.

    Thanks

In my experience they don't investigate. I always thought an investigation consisted of trying to discover the truth, but not in these cases.

My daughter was falsely accused of GBH and before she was even asked to attend for interview, the investigating officers had already spoken to neighbours and other possible witnesses in an attempt to determine what had actually happened.

But hey? What's news worthy about GBH?

Usually with historic allegations, the Police will access the accuser's medical records, social services records, housing, school and any other relevant information such as involvement from other agencies like a psychiatric report.

They will also undertake a lot of background checks on the suspect including accessing phone records, employment history checks, cava checks, previous convictions, previous address checks, Facebook account checks and police intelligence.

Also, they will interview any potential witnesses or people the accused states they have confided in about the allegation. They may reinterview the accuser if they have further questions or there are inconsistencies in their statement.

They essentially are seeking information to support the allegation and a lot of the information they acquire will probably be irrelevant but helps them to form an overall picture of the situation such as who the alleged suspect socialises with, their family background and work patterns etc.

Excuse me. There's no need to be so rude. I suggest you read the information online about police investigations and how they are carried out.

Unfortunately, the Police do seem to be only interested in a guilty verdict to help their statistics. They will also disgard any evidence that undermines an allegation.

It is the CPS who would usually obtain certain kinds of evidence, such as medical /psychiatric etc. It really depends on what the complainant said the the police and what the accused told them (if it doesn't help the defence case).

I know that solicitor Chris has often applied through the courts (usually via Tania QC) for disclosure of those records, if the CPS haven't bothered to obtain them, or refuse to disclose them to the defence. They cannot be disclosed on a whim / fishing expedition. For instance, defence can't have sight of them "just in case there is something useful" in there. An argument has to be provided that the judge will approve.

Shah is correct, in that what we see online with regards to PACE and the duties and responsibilities of the police and CPS, is not always followed through.

if there weren't Government-set rape / sexual abuse conviction targets, then the police and CPS would more likely investigate cases properly.

The Police do have certain guidelines which they have to follow when conducting these types of investigations but the problem is they don't always follow them through in a fair or impartial manner. The evidence they obtain will be to try to prove the allegation and the accuser's statement is also classed as evidence even when we know its a false allegation.

                    Yes well Said Shah......

With all due respect I think we all know what is written on the "internet " regarding police Investigations legislation etc!!!!!

The Sheer truth of the matter is it really does mean absolutely FA!!!

People often think that they can trust the relevant authorities; ie CPS,POLICE,SOCIAL SERVICES,ETC to follow guidelines and legislation........

The truth of the matter is this is naivety........

Many on this forum would agree......that these authorities are corrupt......show a blatant lack of common sense....and show blatant disregard to the utter damage False accusers can cause.........

In my own experience..... Social services for example are without doubt the most....institutionally corrupt........ Many are unqualified...... And many are deeply disconnected with the "real world".....as someone quite rightly said SS stands for **** stirrers!!

Yes of course there are also good honest......people working for these authorities....ie in the police......CPS ss etc

But the sad truth is......institutional corruption in many of these so called public authorities/agencies is clearly very apparent......and if anybody is to believe other wise then they are seriously very naive....

And to those people who believe that they are safe and can expect an honest trustworthy service from these authorities (Police CPS,ss etc).....God help you.......!!!!

I have personally witnessed....many many things in my experience with these authorities...from racism......discrimination..... Fabricating....paperwork...to suit thier needs.....and I haven't even got started yet!......

Our OIC seems okay (i can't hate a man who recommended NFA, I just can't) but i've seem some evil stuff from the police. My friend and I were in town with the kids just after Christmas and it was freezing and raining and a homeless man was trying to keep this sleeping bag dry near a shop door way. My friend brought him a McDonalds meal and coffee and was talking to him, we walked off and suddenly a female PCO came from nowhere. Telling him to move on she was so aggressive and was so clearly enjoying lording it over him with a massive smug grin. I've not really had a lot to do with the police so just stood there in disbelief.
I don't mind SS but i really dislike the CPS to be honest all the witnesses are in OH's favour, OIC has recommended NFA, no arrest yet they have held on to this case for three months, I really feel they are trying to pin this on him even though all the evidence points to him being innocent. Really really don't like the CPS.

What the police and CPS (and SS) are supposed to do is often completely different to what actually happens.

Some people FA'd have good experiences with them all and some have terrible experiences with one, two or all of them. It's often down to the character of the officers in all camps, rather than the organisations as a whole.

My friend Rob who got me into this mess (!) had obligingly handed over 53 pieces of evidence to the police before the trial while they were "investigating" it, after which the police denied that happened. At the appeal CPS asked the police "where is this evidence?" Answer: "We've mislaid it". How can one mislay something they never had?

The police officer in the case was corrupt as were some of her colleagues.

They seem to be able to do as they please. If OIC had been on a power trip he could have arrested OH which would have got him suspended and called ss who could have made him move out. Glad he was decent! Police have way to much power, its suppose to be innocent until proven guilty.

However he did lie about witnesses and try and trip them up!

Because we had my grandson since he was 2 (10 years) we were heavily involved with SS as he was considered a "Looked after child" and under the jurisdiction of the Children's Panel in Scotland.

EVERY SINGLE ONE of our accusers had extreme involvement with SS , all but one having been in care at some point.
We know for a fact that one of them , at younger than nine, had been shown "pornographic material".
The ringleader was known to my 2nd sol as he had a son at the same school- on hearing the name, the first thing he said was that he knew him, he was the lout who had tried to set another pupil on fire and was frequently reported for hitting the school bus driver. He had also attacked kids at school, he thumped a friend of mine's son the day after OH's arrest, we suspect for refusing to join in.

He sexually assaulted my grandson. One of the complainants at trial said this nasty piece of work bullied him into making accusations.

Did anyone take any of this into consideration? Was any of this made available to the defence? The police do nothing.
In my case, accuser claimed the car I had driven at him and his pal (although he wasn't actually there when I had the misfortune to have to pass him in a narrow lane) was "Black, but not very black" when in fact it was a very pale metallic lilac. Did the cops bother? All they had to do was look!!!! Did they??

been 7 months bail so far... they did a 'fair bit' in the beginning (speaking to neighbours of were we lived) and then when i think (hope) they realised that the crime hadn't happened they put it on the back of the pile.

Told them about a message we received in august, showed the OIC that very day, she didn't tell the new OIC who was suprised when i mentioned it (not sure if on purpose but probably just lack of communication hmmm) so re told them about it in october (i think) and sent the small part of the message i had and after christmas they finally sent someone round to get the full messages of the person who received it. after 4 months it was a God send that she still had them!!!!!!!!! (if you hadn't of gathered these messages where in our favour)

but yeah, 7 months so far........... (not what you wanted to hear, sorry )
