I would have thought due to messages having the bonus of being able to be verified in realtime relatively quickly with times and dates that the way in which it is presented shouldnt be a technical nightmare?..

Courts still work in a sort of isolated bubble, so at present you couldn't just give each member of the jury a tablet and get them to look the messages up themselves there and then.

I guess the reason behind this is that court proceedings are recorded and documented in case of any future appeals and therefore anything presented for consideration by the jury must be verbal or hard copy.

Also, I think there is a danger the other party could permanently delete the messages, thereby losing the evidence prior to it's being needed or used in defence.

Hey JM,

Facebook messages cannot ever be deleted. They are always held either in the inbox or archive folder. There is no longer a delete option.

Edit: Just discovered a delete button.. that is annoying. I was relying on the police being able to see the communication between the girls. Becomes a lot trickier when the messages are "gone".

\The woman who has accused my son of rape stalked him via facebook so he deleted that particular one and opened another account , i have gone through all their legal jargon and not even a court can order them to surrender information , though i dont know if that is in the USA maybe its different here . wish we knew how to get access to his old account x

Under guidelines- "We disclose account records solely in accordance with our terms of service and applicable law. A Mutual Legal Assistance Treaty request or letter rogatory may be required to compel the disclosure of the contents of an account."

I believe this is like them accessing emails, phone contents. If they want to, they can..

Jurors can be given hard copies of the Facebook evidence. Obviously they cannot be issued with tablets etc otherwise that would give them access to the FB / Twitter /whatever accounts.

I've known screens and projectors used so one would think that computerised evidence could also be given via screen/laptop.
