  • Bail advice please

    Hi
my hubby is on bail and is due to go to cc next week then get a date for plea hearing then cc trial, on his bail conditions all it states is not to go near the accuser and her partner ( as if ) but before this nightmare started we had booked a holiday abroad for early next year will we have to get permission for him to go as he is on bail. thansk

We went abroad after my hubby was accused but before he was charged. He had to get permission from Plod, but otherwise it was all OK.
Speak to your sol. As your hubby has been charged it might be different. As long as you are not going anywhere that doesn't have an extradition agreement in place you should be OK.

If not leaving the country was a bail condition it would say. We went away whilst on bail and charged. Our only condition was not to go near the accuser, like you say, as if!

Better safe than sorry - you don't want to be accused of absconding so tell Plod anyway.

          I agree with the above,

Notify your solicitor in advance. They can confirm that there isn't an issue with your bail conditions and if necessary apply to the Court for a bail variation.

If there is any doubt they may ask you to produce a copy of the tickets to show when it was booked and that it is not open ended.

          Usually openness is best policy.
Hope this post helps. But this post does not constitute legal advice, nor a contract/agreement for it.
