  • Ched Evans - wins appeal against conviction

In the news today although he could face a retrial. I always suspected he may be innocent after reading information on his website about the accuser and other circumstances of the case. This will be highly embarrassing for the CPS and Police but will hopefully highlight concerns about other cases of false allegations and miscarriages of justice.

Hopefully we will find out what the "fresh evidence" is that caused the appeal to succeed. I was astonished when it did as Hallett LJ was the presiding judge and she is notorious for rejecting sex cases appeals out of hand......

If it was about back handers then other judges would be well known for refusing sex case appeals. She is notorious.

One last year, where the mother of the little boy hit him with a belt shouting at him "what is wrong with your bum, what did B do to your bum" - so of course the little boy says what she wants to hear to stop the beating and shouting. Hallett LJ said that that "is totally irrelevant". She claimed his evidence at trial was entirely credible. It would be wouldn't it - his mum was waiting for him, so he had to carry on with it otherwise he would risk another beating. The reason our man wouldn't leave her when she told him to go, was because he had two children with her, and by that time realised what a cowardly bully she was to all the kids, so he wanted to stay to protect them.

I think this is the first time I've heard of Hallett LJ allowing a sex case appeal. Maybe the other two judges persuaded her.

I think also maybe it is her who insisted on the retrial for Ched Evans, when he's already served his jail time.

Usually the court decides that "it is not in the public interest" to order a retrial (financial reasons and as the sentence cannot be increased and the time in prison has been served, it's pointless.
