BBC Story Andy Malkinson's 20-year road to seek justice
This is an alarming tale but not surprising to members of this forum who have also been falsely accused; but in this instance there appears to be no motive for the victim to falsely identify him as the perpretator?
It was reported yesterday that, if he recieved compensaion for this miscarriage of justice the prison service *could* then send him a bill for the cost of his accomodation and food for his time in prison, unbelievable!
Unbelievable but true CH. If you pass the very high bar of proving innocence beyond a reasonable doubt rather than simply undermining the safety of the conviction, you will be entitled to compensation but first, they deduct your room and board. Many that have their convictions quashed receive nothing at all. Disgraceful doesn't begin to describe it.
This case is truly awful and includes most of the features familiar to anyone that has spent time looking at miscarriages of justice; a poor police investigation,non disclosure of vital evidence at trial, failure of the CCRC to investigate and uncover the DNA evidence (twice) and the innocent prisoners dilemma - Mr Malkinson spent far longer behind bars than his original tariff because by refusing to admit the offence he didn't commit, he was deemed to be in denial.

You like to hope lessons will be learned and there will be some serious reform of the CCRC but the news has been dominated by a failed politicians posh bank account for what feels like 6 months and this shocking case has gone somewhat under the radar.
