  • Rape case rejected by Crown Prosecution Service

    Don't know if anyone can help me. Im trying to find out some information on behalf of a family member. The person concerned was raped and abused by a "family friend" 18 years ago. At the time the rape was reported, and there was medical evidence. However because the victim was very young (4), and would not of been able to stand up in court the Crown Proescution Service rejected the case. Now 18 years on the victim wants Justice. However because the CPS rejected the case once we have been advised that they will not now allow the case to go to court unless new evidence was found. The guilty person has actually admitted the rape to several people. Does anyone know if this would stand as new evidence? Or indeed where or if any legal steps can be taken. This person has raped more than one family member. As well as wanting justice, we obviously do not want this to happen to any other innocent little child/person. Any information would be of great help.

    Maybe you could ask the citizen's advice bureau

      I can't see she can't try to get this case prosecuted. It would be difficult to try as her memory would not stand up to cross-examination if the perpetrator denies guilt. A medical expert would probably be brought in for defence to tell the jury that a person making complaints from a time before the age of five would not have a clear memory. This has been the subject of some appeals against conviction. It might help the victim if she undergoes a psycology test to boost her case.

      The people who he's bragged to - their evidence might be admissable as "hearsay" so although not actual evidence of the assault it's supporting evidence if the jury believes it.

      The medical evidence that was found at the material time would of course be used if it's still available. However, does this victim want to go through all this? For genuine victims of rape it is an absolute nightmare - for those who make false allegations it's easy. People who make false allegations of sexual abuse actually make the genuine cases far worse for the real victims.
