    Hi there,

    My 14 year old son was charged with rape 2 days ago by a girl a year younger than him at school. The shock is indescribable. Would appreciate any advice anyone has to share at this awful time

    was your son interviewed, did he have a sol with him at the time? was he with any off his friends at the time?

      He was interviewed but wouldn't have an sol with him as he said he didn't feel he had done anything wrong. I think he felt he would make him look guilty. I have since saught legal advice. There was only the two of them there when this happened unfortunately. She has no marks on her & says she didn't ask him to stop/ shout for help???

        To enable members to give the correct advice do you mean the girl accused him of raping her or has he been charged by the police with rape?

          The girl has accused him & the police arrested him & charged him. He is bailed until January

            Hi and welcome to the forum though I am so sorry you have had to find us. You will get lots of advice and support here.

            things to think about/do immediately

            - your son must not talk to the police at all without a solicitor present
            - when talking to plod ONLY answer questions they ask and don't volunteer any other info which may help to prove innocence. Plod is not interested in this - this info is for your sons defence team should he ever need one
            - as your son is under 17 he has further protective rights - though I don't know what they are - someone will be along shortly to advise
            - he must go on her FB page and make screenshots of anything she posts - verbally or pics - which show what she is doing with/saying to friends. Anyone who is traumatised by being raped will very often change their behaviour completely; also she may be bragging about what she has done in accusing your son and give lots of hints towards that she has lied. These screenshots must be stored electronically somewhere where plod won't get them - they may seize your sons computer.
            - store any text messages between your son and the girl - similarly somewhere where plod won't get them - they may seize his mobile phone too.

            Finally, don't underestimate the traumatic affect this will have on your whole family - it is indeed a dreadful dreadful place to be. You will need support as well as your son - you may find your GP a great source of comfort, advice and support

              Were the girl and your son friends in the sense that others would have considered them to be girlfriend and boyfriend? If so it is surprising that the CPS have gone down the charging route as the policy is (or was!) not to prosecute in these circumstances:

              It should be noted that where both parties to sexual activity are under 16, then they may both have committed a criminal offence. However, the overriding purpose of the legislation is to protect children and it was not Parliaments intention to punish children unnecessarily or for the criminal law to intervene where it was wholly in appropriate. Consensual sexual activity between, for example, a 14 or 15 year-old and a teenage partner would not normally require criminal proceedings in the absence of aggravating features. The relevant considerations include:

              the respective ages of the parties;
              the existence and nature of any relationship
              their level of maturity;
              whether any duty of care existed;
              whether there was a serious element of exploitation.

                Hi Hellsbells, very interesting and valid information from CH.

                What I'm concerned about is that your son, a child, was interviewed without a laywer present and without an appropriate adult.

                He is entitled and should obtain a copy of the police detention records, these have to be applied for within a year. If his rights have been violated , it could alter whether the case is allowed to go ahead or not.

                I would strongly (extremely so) advise you to seek advice from a solicitor who specialises in sexual allegations who also specialises in dealing with children.
                I can't stress strongly enough how important this is. Have a look under specialist solicitors in the General Information.

                I can imagine just how frantic you are. The right help and advise will be invaluable.

                      I was signposted to your thread as it sounds so very similar to mine. My 15 year old son was arrested, interviewed and bailed 11 days ago until January. Don't know what to do, I'm a wreck and can't focus on anything....just feels like I'm constantly waiting... Will hope things are sorted out for us and our sons ASAP xx

                        Hi i am in a similar situation as a few of you please do get on touch so we can support each other the first few days/weeks are the worst i cried all day every day didnt want my son to go out was so worried sonething would happen to him but as each day passes you do get stronger go to the docs to get some help xx

                          Hi,

                          I have cried so much too, and feel so much for you all. We are waiting for CPS to make a decision in January about our son. We feel it is a set up by this girl's family for huge compensations pay outs of up to £100k, Gosh! What an incentive!.. So many women crying wolf now, since they have heard about large pay outs from media news on celebrities etc. This country is a total disgrace to allow this to happen. I will fight this all the way and appeal if it comes to that. My son is totally innocent and also has a very limited life-span due to his illness. If he got 8 years plus then that would be like a life sentence to him. I am so upset, I can not function much at the moment. Also the Government is covering figures on how many woman are making up these lies, because my son has a good group of decent friends, all at work or in university, however, out of 10 of these boys ages 20-24, 3 have had to go through this 'witch hunt' system.

                            Hello,

                            Its shocking that 3 out of ten in his group have had to go through this. Was any of them charged?

                            Also if the worst happens then your sons illness may come into the arena but I am no expert and legal matters. To pick up a point should he really have been interviewed without an appropriate adult? is that legally ok?

                              Hi, all three boys cases of the girls false claims were dropped. Two of the boys was not enough evidence and the other boy due to the girl saying after 6 weeks that she didn't mean to get it all muddled in her head and that really she had given full consent. What a joke of a system that is not working in this country, due to the fact people will try and do anything when they hear the word MONEY! Every man and boy in this country are at risk, no matter what culture, status rich or poor, size or shape...anyone can be accused...it is just so pathetic and easy for any woman to do this.
