  • Falsely Accused of Sexual Assault - Is it possible to get deleted texts from the Service provider?

I have been falsely accused of sexual assault. I have spoken to Chris Saltrese and he has taken on my case.

Our life has been hell from the day the police knocked on our door at midnight and I was arrested by the Police. I was taken to prison and questioned till about 5:00 am in the morning. I made the classic mistake of not requesting for a solicitor as I have done nothing wrong and was under the impression that the Police will be able to see through the maliciousness of the accusations. How wrong was I!

I believe, the Police work only with the intention of proving that the accuser is right even when the circumstantial evidence will prove otherwise.

This case is based on one word against other, hers against mine. Lets hope Chris is able to prove my innocence. The case is currently in the magistrates court and will update once it progresses. I am meeting Chris next week and hope he gives me some good news after looking at my case.

Is it possible to get the content of deleted texts from the mobile service provider? Any suggentions/ prior experience will be welcome.

    Hi Ram32 and welcome.
The good news is that you couldn't ask for a better solicitor than Chris Saltrese, so you are in good hands.
With regard to the text messages, I think it should be possible to retrieve deleted texts, but I am not 100% certain. Have you spoken to your service provider? If they are able to get the messages back, they will probably be reluctant to do so unless they are instructed by Chris.
Most FA cases (and most genuine ones) are a matter of word against word. The jury are simply asked to decide who they believe. Witness credibilty is pivotal.
Others will no doubt be along soon with more advice. In the meantime, Welcome.

The service provider is unlikely to be helpful but a forensic expert should be able to retrieve the messages if you have the mobile phone or if it is available.

I am surprised you have not yet met solicitor Chris prior to the court hearing- or have you just instructed him?
