  • Over two years and still no NFA

    Hi,

    My FA was over two years ago now. Interviewed under caution, never charged. There has been zero contact from the police since the interview. Have the CPS dropped this and not even bothered to tell me? I'm not brave enough to 'rock the boat' by contacting them to ask.

    The company I'm working with has taken on schools as clients (computer networking). Everyone else has had their CRB checks back, mine hasn't come through yet. I was told 'interview under caution' would not be on my records. Is this incorrect and that is why my CRB hasn't cleared?

    Normally I see 'no news' as 'good news', but my paranoia level is rising.

    As you weren't ever charged there is no requirement for a NFA, though it would have been courteous of the OIC to let you know what was going on.

    The case will still logged on the PNC under some category or other just in case someone else makes a similar accusation but I believe the OIC would need to make a separate entry on the DBS if he felt this was necessary.

    Regarding your query, do note the following:

    4. DBS sends a certificate to the applicant. The employer has to ask the applicant to see the certificate.

      That isn't quite right CH!

      When an allegation has been made to the police, it is either subject to a NFA or a Charge. It's not an NFA after charge.

      If there is a change of mind after a charge, then that is when the charges are dropped.

      The OP needs to get his NFA in writing, given the time that has passed.

        My apologies, and thanks for picking that up, don't know why I wrote 'charged', it should have been 'bailed' (meaning there was an prior arrest which needs disposal)

          No need to apologise

          People who were never arrested will (or should) still get NFA'd or No-Crimed. Many attend "voluntary" interviews and never actually arrested - the cases still need to be "disposed of" and either result in a NFA or charge.

            I thought it was possible to enquire as to your DBS record, does anyone know or has done this. I believe you could do this without contacting the officers who dealt with you earlier. If I'm correct perhaps that would be a good way to put your mind at rest or at least give you more information
