  • Who can I contact..I feel the system has let me down..

    Hi guys

As you know I was acquitted yesterday after a 2 year ordeal..

I have been told by many that I should of never had been prosecuted anyway, the evidence was weak, I was young and it happened so long ago..

I have been told I cannot reclaim the cost back for my barrister and solicitor but it just seems so unfair...

    2 questions...

Who would you contact to complain about the process of going to court??
Who would you contact to complain about paying privately... When legal aid was more expensive then going privately... And I could get a QC!!!

Any help / advice would be appreciated..

    Many thanks

    IG

After the elections next week , hopefully the new Lord Chancellor / Justice Secretary.....

Did the judge tell prosecution that the case should never have got to trial? If so, and if you can afford it, request that part of the trial transcripts so you have proof he did, and then I might be able to direct you somewhere.... The transcript of that shouldn't cost too much.

Yes some sols charge private clients less than the contributions to Legal Aid. Did you pay privately, out of interest?

      Hi RF

The judge never said to the prosecution that the case should never of gone to trial..

However, when the trial was supposed to happen the second time around the prosecutor said to the judge that they are changing the indictments from 14-16 to 10-16. The prosecutor explained the jury would be unable to know if it was pre or post 14.. so he had to include it.. the judge at the time said.. if these are not included... how are you going to get the conviction... to which the prosecutor said.. I dont know..

The judge resheduled the trial for 6 months for the prosecutor to get evidence.. to which there was none.. and the trial continued.. (Im imagining they all forgot about the conversation from 6 months ago..)

I have the money, and I will pay for the transcripts... however will they include every time I went to court?? as its the second trial start date that will count.

I really feel I have been victimized here...

Thanks for your help as always

Ask the solicitor to contact the court reporters (transcribers) to ask for a quote for the specific parts of the transcripts that relate to the judge's comments as to any criticism of the CPS in bringing the matter to trial including the bit where he said along the lines of "how do you think you will gt a conviction without the first 10 Counts?"

I am going away but will try to keep updated on this thread.
