A memory aid for remembering the necessities for arrest as amended to s.24 PACE Act 1984 by s.110 SOCaP Act 2005

I - Investigation (to allow prompt and effective of the offence/conduct of the person)

D - Disappearance - prevent hindrance of prosecution by disappearance of suspect

        C - Child (Protect child/vunerable other)

O - Obstruction of highway (prevent)

        P - Physical injury (prevent)

P - Public decency (prevent commission of offence against)

s.5 potentially public decency, if reasonable members of the public cannot be expected to avoid person in question - I personally believe that the statutory power of arrest for s.5 POA should have been retained, although to my knowledge there has been no appellate case law on the legality of an arrest under s.24 for s.5. For other PO Act offences, potentially, you might be wanting to prevent physical injury, for a s.4 offence, although for any of them you might not know the persons details, they might be so drunk that they cannot be dealt with any other way, making P+E a reason to arrest to allow them to be charged and to prevent them disappearing because they don't remember the incident, or they might not be willing to/able to give correct details. Although for all the other offences ss.4A, 3, 2 and 1, you will be wanting to interview, therefore prompt and effective investigation is a good necessity.

        L - Loss/damage to property (prevent)

        A - Address (of suspect not known/doubted)

        N - Name (of suspect not known/doubted)
